Description: Alexandria, VA - BMG Rights Management (US), LLC sued Cox Communications, Inc., FoxCom, LLC and Cox Enterprises, Inc. claiming that the defendants violated copyright laws by failing to reasonably implement a repeat-infringer policy and claiming that it was not entitled to the safe harbor exception under the Digital Millennium Copyright Act. Plaintiff claimed that Cox to be less than cooperative in attempts to send demand letters to individual pirates.
Outcome: Plaintiff's verdict for $25 million based on a finding by the jury that Cox was liable to contributory copyright infringement and that its actions were willful.
